Buying and Selling Rules

TERMS AND DEFINITIONS
1.1. Seller – Partners in Comms Consulting, company code 306121780, registered at Šeimyniškių g. 22c-1, Vilnius, email [email protected], phone +370 62843711, whose goods are sold in the online store https://partnersincomms.com/.

1.2. Buyer – a person who meets the requirements set out in Clause 2.2 of these Terms and Conditions of Sale and Purchase and has purchased goods in the online store https://partnersincomms.com/.

1.3. Parties – Buyer and Seller collectively.

1.4. Partners in Comms Consulting – a consulting company established and managed by the Seller, specializing in communication services, providing training, and having published three books aimed at enhancing internal communication and employer branding within organizations. Buyers have the opportunity to purchase books and register for training sessions.

1.5. Terms and Conditions of Sale in the online store https://partnersincomms.com/ (hereinafter – the “Terms”) – a remote sales contract establishing the rights and obligations of the Buyer and Seller, conditions of payment and termination of orders, training registration, and liability of the parties.

1.6. Sales Contract – a sales agreement concluded between the Buyer and the Seller, consisting of the goods submitted by the Buyer to the Seller via the online store https://partnersincomms.com/ and these Terms, including any subsequent amendments and/or supplements.


GENERAL TERMS
2.1. Under the sales contract, the Seller undertakes to sell and transfer the purchased and paid-for goods to the Buyer, and the Buyer undertakes to pay for and accept the goods.

2.2. Only visitors of the online store https://partnersincomms.com/ who meet the following requirements are entitled to purchase goods and register for training:

2.2.1. legally capable natural persons, i.e., individuals who are at least 18 years old and whose legal capacity has not been restricted by a court.

2.2.2. legal entities.

2.3. Before purchasing goods in the online store https://partnersincomms.com/, the Buyer must read and accept these Terms. The Terms confirmed by the Buyer constitute a binding legal document for both Parties.

2.4. The Buyer has no right to order goods in the online store https://partnersincomms.com/ if they have not read and agreed to these Terms. If the Buyer does not agree with the Terms or part thereof, they cannot order goods or training in the online store.

2.5. The Seller has the right to amend and/or supplement the Terms. Any amended Terms are published in the online store https://partnersincomms.com/ and take effect from the moment of publication.

2.6. Before purchasing goods in the online store https://partnersincomms.com/, the Buyer must also read and agree to the Privacy Policy of the online store. The Buyer’s personal data is processed in accordance with the Privacy Policy.


FORMATION OF SALES RELATIONSHIP
3.1. When placing an order in the online store, the Buyer must provide the required personal data, which the Seller stores and processes according to the Privacy Policy.

3.2. Once the Buyer completes all order steps and submits the order, a legal sales relationship is established between the Buyer and Seller, and the Sales Contract is considered concluded.

3.3. The Buyer is informed of payment confirmation via email sent to the address provided during the order.

3.4. Each Sales Contract concluded between the Buyer and Seller is stored in the online store and handled in accordance with the Privacy Policy.


BUYER’S AND SELLER’S RIGHTS AND OBLIGATIONS
4.1. The Buyer must pay for and accept the purchased goods in accordance with these Terms.

4.2. The Buyer undertakes to comply with these Terms, the Privacy Policy, and applicable Lithuanian laws.

4.3. The Buyer has the right to purchase goods and register for training in the online store in accordance with these Terms.

4.4. The Buyer has the right to cancel an order and terminate the Sales Contract in accordance with these Terms.

4.5. The Seller undertakes to fulfill the Buyer’s orders in accordance with these Terms.

4.6. The Seller undertakes to process the Buyer’s personal data only in accordance with these Terms, the Privacy Policy, and applicable Lithuanian and EU law.

4.7. The Seller undertakes to comply with these Terms, the Privacy Policy, and applicable Lithuanian laws.

4.8. The Seller has the right to cancel the Buyer’s order without prior notice if the Buyer fails to pay for the purchased goods.

4.9. The Seller may contact the Buyer regarding the order, payment, shipping, or provided contact information.


PAYMENT TERMS
5.1. All payments in the online store are calculated and made in euros.

5.2. The Buyer may pay via online banking or other methods. Payments are processed using the https://opay.com payment intermediary system.


DELIVERY OF GOODS
6.1. Purchased goods and related materials are sent to the Buyer via email provided during the order.

6.2. Delivery is carried out within the indicated timeframe, depending on the quantity of goods and Buyer’s location. Delivery costs and conditions are specified at the time of order.

6.3. If agreed by both Parties, goods may be delivered in person at a meeting.


ORDER CANCELLATION AND RETURNS
7.1. If a Buyer starts an order but does not pay, the Seller sends a reminder. If payment is still not received, the Sales Contract is considered not concluded.

7.2. Returned goods must be unused and original protective films or labels must not be removed. For damaged or defective goods, contact [email protected] within 48 hours of receipt.

7.3. Non-defective goods are not accepted for return.


COPYRIGHT
8.1. All content of the online store and the Seller’s products are intellectual property of the Seller, including (but not limited to) product images, descriptions, training content, books, etc.

8.2. Any use, copying, or distribution of the online store’s content or Seller’s product content without the Seller’s consent is prohibited. This applies even if the Buyer is a legal entity violating Clause 2.3 of these Terms.


LIABILITY OF THE PARTIES
9.1. The Buyer is responsible for all unlawful actions using the online store.

9.2. The Buyer is liable under Lithuanian law for actions under Clause 8.2.

9.3. The Buyer is responsible for the accuracy and completeness of data provided in the online store.

9.4. The Seller is not liable for damages resulting from incorrect, incomplete, or outdated data provided by the Buyer.

9.5. The Seller is released from liability if the Buyer partially or completely fails to read these Terms and the Privacy Policy, although the opportunity was provided.


FINAL PROVISIONS
10.1. To submit a notice, complaint, or claim, the Buyer may contact the Seller at [email protected] or +370 62843711 during business hours (8:00–17:00). An email notice is considered received 24 hours after sending.

11.2. If the Buyer, as a consumer under Lithuanian law, disagrees with the Seller’s response, they may contact the European Consumer Centre in Lithuania (Vilniaus g. 25, 01402 Vilnius, [email protected], +370 5 265 0368, https://www.ecc.lt/lt/).

11.3. Any matters not regulated by these Terms are governed by Lithuanian law.

11.4. All disputes arising from this Agreement are resolved amicably. If no agreement is reached, disputes are resolved in Lithuanian courts under applicable law.

11.5. All disputes arising from the Agreement are subject to Lithuanian law.
