1. TERMS
1.1.The controller of personal data is Partners in comms, company code 305693515, registered at Žirmūnų g. 70C-64, Vilnius, e-mail address [email protected], whose Goods are sold in the online store https://partnersincomms.com
1.2. e-shop – an electronic shop operated by the Personal Data Controller at https://partnersincomms.com.
1.3 Goods – any Goods (books) offered by the Personal Data Controller in the Online Shop.
1.4 Customer – a physical person – a customer, including website visitors, whose personal data is collected by the Personal Data Controller.
1.5 Personal Data – any information relating directly or indirectly to the Customer, whose identity is known or can be identified directly or indirectly by reference to the data concerned.
1.6 Processing of Personal Data means any operation (including collection, recording, storage, editing, alteration, access, request, transmission, archiving, etc.) performed on Personal Data.
1.7 Account – the Customer’s main login details to the Online Shop system, consisting of an email address and a Password.
1.8 Password – a unique combination of numbers, letters, or numbers and letters or other symbols created by the Customer and used to log in to the Online Shop System.
1.9 Partner means a person who provides Goods/services to the Personal Data Controller in connection with the Personal Data Controller’s operations.
1.10. Direct Marketing – means operation designed to offer Goods/services to individuals by mail, telephone or other direct means, including but not limited to sending newsletters, special offers, invitations to participate in promotions/events and/or operation designed to ask for their opinion on the Goods/services by mail, telephone or other direct means.
1.11. Cookie – means a small piece of textual information that is automatically created when browsing a website and is stored on the visitor’s computer or other device.
1.12. Privacy Policy – this document, which sets out the principles and rules for the processing of Personal Data when using the Online Shop.
2. GENERAL CONDITIONS
2.1 The Customer authorises the Personal Data Controller to conduct all Personal Data processing operations within the scope and for the purposes provided in this Privacy Policy.
2.2 Personal Data is processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC, the Law on the Legal Protection of Personal Data of the Republic of Lithuania, and other legal acts governing the processing and protection of Personal Data, and this Privacy Policy.
2.3 Personal data is processed in accordance with the following principles:
2.3.1. personal data is collected for defined and legitimate purposes;
2.3.2 personal data is processed accurately, fairly and lawfully;
2.3.3. personal data are suitable and only to the extent necessary for their collection and further processing;
2.3.4. personal data are kept up to date;
2.3.5. personal data is kept in a form which permits the identification of the Customer for no longer than is necessary for the purposes for which it was collected and processed;
2.3.6 all information regarding Personal Data is confidential;
2.3.7. the Client’s Personal Data and other information will not be used for any unlawful purpose.
2.4 The Controller shall implement organisational and technical measures to protect Personal Data against accidental or unlawful destruction, alteration, disclosure, as well as against any other unlawful processing.
2.5 The Customer is responsible for the accuracy, correctness, completeness and correction of the Personal Data provided through the Online Shop in the event of changes to the Personal Data.
2.6 The Customer must read and agree to this Privacy Policy before purchasing Goods from the Online Shop.
2.7 The Customer shall not be authorised to order Goods in the Online Shop unless the Customer has read and accepted this Privacy Policy. In cases where the Customer does not agree with the Privacy Policy or any part thereof, the Customer shall not be able to order Goods in the Online Shop.
2.8 The Personal Data Controller has the right to change and/or add to the Privacy Policy. The modified Privacy Policy shall be published in the Online Shop. All changes and/or additions to the Privacy Policy shall come into force from the moment of their publication on the Online Shop.
3. CUSTOMER ACCOUNT
3.1 The Customer may submit an order in the Online Shop without registering, or by logging in to the Online Shop through their Account.
3.2 When registering for the Online Shop through the Account, the Customer must provide his/her name, surname, password, email address and create a secure Password.
3.3 The Customer has the right to modify the Personal Data in the Account at any time or to contact the Personal Data Controller with a request to cancel the Account.
4. PERSONAL DATA PROCESSING, COLLECTION, PROTECTION
4.1 The Customer’s Personal Data is processed, collected and stored for the following purposes:
4.1.1. for the purpose of e-commerce. Personal Data processed: name, surname, email address, telephone number, city, Facebook nickname.
4.1.2. for direct marketing purposes. The following Personal Data is processed: name, surname, telephone number, email address.
4.1.3. for other purposes for which the Personal Data Controller is authorised to process the Customer’s Personal Data where the Customer has expressed his/her agreement, where the processing is necessary for the legitimate interest of the Personal Data Controller, or where the processing is required by the relevant legal acts of the Personal Data Controller.
4.2 Personal Data collected by the Personal Data Controller is stored in the Personal Data Controller’s information systems in electronic format. The processing of Personal Data shall not be longer than is necessary to achieve the purposes of the processing of the Personal Data or longer than is required by the Client and/or provided for by law.
4.3 The Client may give permission for the processing of his/her Personal Data (name, surname, telephone number, e-mail address) for the purpose of Direct Marketing. If, after giving permission to process his/her Personal Data for the purpose of Direct Marketing and to receive Direct Marketing communications, the Customer no longer wishes to do so, he/she must inform the Personal Data Controller.
4.4 The Customer shall have the right to withdraw its consent to the processing of the Customer’s Personal Data for the purpose of Direct Marketing, as set out in clause 4.3, at any time by giving the relevant notice to the Personal Data Controller at [email protected] and clearly indicating that it withdraws its consent to the use of its Personal Data for the purpose of Direct Marketing and that it does not wish to receive any Direct Marketing Communications.
4.5 The Customer also has the right to withdraw its consent to the processing of the Customer’s Personal Data by the Personal Data Controller for the purpose of Direct Marketing, as set out in section 4.3 above, by clicking on the relevant link contained in each electronic Direct Marketing communication sent to the Customer by the Personal Data Controller.
4.6 The Customer agrees that, in cases where it is necessary to do so on the instructions of competent authorities and/or the Customer’s Personal Data may have been used in the course of an illegal activity, or where there are reasonable grounds for suspecting identity theft, for which a pre-trial investigation is being conducted by competent law enforcement authorities, or for other legitimate grounds or purposes, the Customer’s Personal Data will be stored on the servers of the Personal Data Controller for a longer period of time than that specified in this Privacy Policy.
5. PROCESSING OF PERSONAL DATA
5.1 The Client’s Personal Data shall not be disclosed to third parties, except in the following cases:
5.1.1. where the Customer’s consent has been obtained as set out in this Privacy Policy;
5.1.2. personal data for the purposes of electronic commerce are provided to Partners who provide services to the Personal Data Controller in connection with the Personal Data Controller’s operations;
5.1.3. personal data is provided to the competent authorities in cases provided for by the laws and regulations of the European Union.
5.2 The Customer consents to the transfer of his Personal Data to the Partners for the purpose of fulfilling the Customer’s order placed in the Online Shop.
5.3 In the Online Shop, the Customer’s payments are processed through the Connectpay or OPAY payment intermediation system, which is operated by Connectpay or OPAY, and therefore the Customer’s personal information necessary for the execution and confirmation of the payment is transmitted to Connectpay or OPAY.
6. COOKIES
6.1. the Personal Data Controller, in order to offer the Client full services, with the Client’s agreement, records information on the Client’s computer (device) – cookies, which is used to identify the Client as a previous user of the Online Shop, collecting statistics on the traffic of the Online Shop, information about the shopping cart.
6.2 The Customer may at any time view the information (Cookies) recorded by the Personal Data Controller and may delete some or all of the cookies recorded.
6.3 The Customer has the right to object to the recording and use of information (Cookies) on the Customer’s computer/device, however, in such case, some of the functions of the Online Shop may not be available to the Customer. By using the Online Shop, the Customer agrees to the recording of information on the Customer’s computer (device). The Customer may withdraw his/her consent at any time by changing his/her web browser settings or by contacting the Personal Data Controller by e-mail at [email protected].
7. FINAL PROVISIONS
7.1 The Client, in order to submit an inquiry, complaint, etc. regarding the processing of Personal Data, may do so by contacting the Personal Data Controller at the e-mail address – [email protected]. A notification by e-mail shall be considered as received when 24 hours have expired after the moment of its sending.
7.2 The Personal Data Controller receiving an enquiry from the Customer relating to the processing of Personal Data shall provide the Customer with a reasoned response, satisfying or refusing the enquiry, no later than 30 (thirty) calendar days from the Customer’s request.
